General Terms and Conditions of Sale - MoovMoov

Welcome to the General Terms and Conditions of Sale (GTCS) page of MoovMoov. These terms govern the contractual relationships between MoovMoov, a limited liability company under Belgian law, registered under the business number 0716.643.522, with its registered office at Avenue Franklin Roosevelt 56, 1050 Ixelles, and its customers.

These GTCS are adapted to both business customers (B2B) and individual customers (B2C). Sections specific to each type of clientele are distinguished where necessary.

1. Preamble

These GTCS apply to all sales made by MoovMoov via its various sales channels (website, marketplace, etc.).
Acceptance of the GTCS is mandatory for any order, without reservation or modification by the Customer. The GTCS prevail over any other document or contrary condition from the Customer.

2. Scope

Business Customers (B2B)

These GTCS apply exclusively to business customers purchasing products or services for commercial, professional, or industrial purposes. They do not apply to consumers.

Individual Customers (B2C)

These GTCS apply to any order placed by a consumer, regardless of the sales channel used, in accordance with the Belgian Code of Economic Law and the consumer protection rules in force in the European Union.

3. Products

The characteristics of the products are described in the product sheets available on our sales platforms.
The photographs are provided for illustrative purposes. Minor differences between the images and the delivered product may occur without engaging the responsibility of MoovMoov.

4. Orders

Business Customers (B2B)

4.1. All orders must be made in writing (email, purchase order, or any other accepted electronic medium).
4.2. The order becomes final after written confirmation from MoovMoov.
4.3. Order modifications are only possible with MoovMoov's written agreement before product shipment.

Individual Customers (B2C)

4.4. Orders can be placed via MoovMoov's sales platforms.
4.5. An order is only considered final after confirmation and receipt of full payment.
4.6. In case of product unavailability, MoovMoov will inform the Customer promptly and offer a refund or an alternative.

5. Price

Business Customers (B2B)

5.1. Prices are stated in euros excluding taxes (excl. VAT), unless otherwise stated.
5.2. MoovMoov reserves the right to change its prices at any time. The applicable prices are those confirmed at the time of order.
5.3. Transportation, customs, and other ancillary charges are the responsibility of the Customer, unless otherwise stipulated.

Individual Customers (B2C)

5.4. Prices are stated in euros including all taxes (incl. VAT).
5.5. Delivery charges are specified to the Customer before order validation.
5.6. MoovMoov can change its prices, but products will be invoiced according to the prices in effect at the time of order validation.

6. Payment Terms

Business Customers (B2B)

6.1. Invoices are payable within 30 days net from the date of issue.
6.2. In case of late payment, penalties of 10% per annum and a fixed indemnity of €40 will be applied.
6.3. MoovMoov reserves the right to suspend any order in case of non-payment.

Individual Customers (B2C)

6.4. Payment is made at the time of order by credit card or bank transfer via secure protocols.
6.5. In case of payment failure, the order will be automatically cancelled.

7. Delivery

Business Customers (B2B)

7.1. Delivery times are indicative and not contractual. The transfer of risk occurs upon delivery of the products to the carrier.
7.2. In case of damaged products, the Customer must notify MoovMoov in writing within 48 hours after receipt.

Individual Customers (B2C)

7.3. Products are delivered in the geographical areas mentioned on the site. Delivery times are indicative.
7.4. The Customer must report any anomaly (damaged product) within 48 hours of receipt, with photographic evidence.

8. Right of Withdrawal

Applicable only to "Individual Customers - B2C"

In accordance with the legislation, individual customers have 14 days from receipt to exercise their right of withdrawal without justification.
Return costs are the responsibility of the Customer, except in case of defect or non-conformity of the product.

9. Warranty

Business Customers (B2B)

9.1. MoovMoov guarantees its products against any manufacturing defect for 12 months from delivery.
9.2. The warranty does not cover damage resulting from incorrect use or normal wear and tear.

Individual Customers (B2C)

9.3. Products benefit from the legal warranty of conformity and the warranty against hidden defects.
9.4. The warranty does not cover damage due to non-compliant use or normal wear and tear.

10. Liability

MoovMoov's liability is limited to the amount of the order concerned, regardless of the nature of the damages. MoovMoov cannot be held liable for indirect damages, such as loss of income or customers.

11. Personal Data

Personal information collected is processed in accordance with our privacy policy. The Customer has the right to access, rectify, and delete their data.

12. Force Majeure

MoovMoov cannot be held responsible in case of force majeure, including events such as strikes, natural disasters, or pandemics, affecting the performance of its obligations.

13. Applicable Law and Jurisdiction

These GTCS are governed by Belgian law. Any dispute will be submitted to the exclusive jurisdiction of the courts of Brussels.
